Everyone was wondering if Nintendo would make a move after the numerous leaks of recent days and/or if it would act after seeing the numerous images exposed by Genki. The latter took to CES 2025 with a mock-up of the hypothetical design of the Nintendo Switch 2. As you would expect, it went viral, as it could be the first time we see the design of the console.
Well, it seems that we already have an answer. Although it is not official, all this fuss could end up having legal consequences for Nintendo. As revealed by French journalist Julien Tellouck, the Japanese company would have sent one of its legal representatives. Will they try to file some kind of lawsuit? That’s something we don’t know.
According to Julien, during his visit to VES 2025 and the booth, he approached Genki’s booth and spoke with some of their staff. Among other things, he explained that they were talking about the Japanese company. “He explained to me that Nintendo has already sent their lawyers to them. However, he says that Genki has nothing to worry about, because they have never signed any documents from Nintendo or any confidentiality agreement.”

Or, in other words, Genki would have obtained information regarding its design from another source. If this is the case, it is true that it would not have any legal responsibility with Nintendo. However, is the case really that simple?
If this were true, could Nintendo argue that they have obtained information about the design of their console (if this is the case) illegally and/or that they would have presented products that are not close to reality?
It would surely be very difficult to prove. Legally, I understand that it is a rather complex issue, so making any kind of prediction would be little more than speculating on a subject about which we really have no idea.
All told, Genki, the Chinese company that showed off the Nintendo Switch 2 replica has ‘confessed’ that they don’t know what the console is really like, so they’ve been playing with all of us. Knowing this, it is understandable that Nintendo’s response was more restrained than expected.
Regarding the official announcement, various sources and rumors say that it will be shown this week, but so far no official statement has been issued.
