It has been several days since the trial against Luigi Mangione, the man accused of shooting UnitedHealthcare CEO to death outside a New York City hotel, has been stalled and for weeks it has been anticipated that he would not return to federal court in Manhattan until mid-February, after prosecutors and attorneys asked for more time to prepare the case for trial.
The lawyers agreed in a letter to the court that the deadline for filing an indictment against Luigi Mangione can be extended from January 18 until February 17.
In the midst of this situation, Mangione’s lawyer Karen Friedman relives her fears that her client will not get a fair trial in the end, as she has been claiming for months that government officials have made prejudicial statements about him.
The possibility that the jury is not impartial
Friedman claims Mangione is being treated as a “sideshow” and that the authorities are “parading him around,” and while the judge promised that the proceedings would be fair and that the jury selection would be careful, in the end no one can be sure what will happen to them, especially amid the growing ‘popularity’ of the defendant based on the motives he had for committing the crime, and which are aligned with the public’s feelings about insurance companies. Some even foresee that he will be acquitted, as part of a phenomenon known as ‘Jury Nullification’.
There are several voices who believe that this possibility may arise, such as Clay S. Conrad, author of the book ‘Jury Nullification: The Evolution of a Doctrine’, who recently told InTouch Weekly that he would not be surprised “if one or more people went into the jury supporting him“. It is known that the jury selection process is designed to eliminate people who will not be impartial, but on this occasion there are strong reasons to believe that around Mangione and his process, it will not be so.
The facts ‘would condemn’ Mangione
The evidence the state has against Mangione is a 3D-printed gun found in his backpack that matches the shell casings from the crime scene, as well as fingerprints taken from a water bottle and protein bar packaging. However, Mangione says he is innocent of the state murder and terrorism charges
However, there is a possibility that he will be declared innocent because of the phenomenon described above, although there is still sanity in the analysis, and it was Syracuse University College of Law professor Gregory Germain who told the publication: “Most of us hate insurance companies and have had difficult experiences dealing with them, but that doesn’t mean we think people should be going around murdering insurance executives in the street.”*With information from Lapresse and reports
